These terms govern your use of this website. They do not govern any engagement between you and Bono Actuaries and Consultants (Pty) Ltd — that is dealt with separately, in writing, before any work begins. By using this site you accept these terms.

2. This site is information, not advice

Everything on this site — including the practice descriptions, the written articles and the interactive experience explorer — is published for general information. It is not actuarial advice, and it is not advice of any other kind. It does not take account of your circumstances, your data or your regulatory position, and you should not act on it without obtaining advice appropriate to your situation.

No client relationship, retainer or duty of care arises from your use of this site, from reading an article, or from sending an enquiry. A professional relationship begins only when we have agreed scope, terms and fees in a signed engagement letter.

3. Financial services

Nothing on this site constitutes advice or an intermediary service as contemplated in the Financial Advisory and Intermediary Services Act 37 of 2002. We are not a licensed financial services provider, we do not advise on or intermediate financial products, and we do not provide investment, tax or legal advice.

4. The experience explorer

The interactive credibility tool on this site runs on simulated data and a simplified limited fluctuation model. It is a demonstration of method. It is not a valuation, a quotation, a rating basis or a recommendation, no reliance should be placed on its outputs, and it must not be used to set an assumption basis for any real portfolio.

5. Accuracy

We take care to ensure that what we publish is accurate at the time of publication, but regulation, standards and market practice change. Articles are dated and are not updated as circumstances change. We give no warranty that the content remains current, complete or accurate, and we are not obliged to update it.

6. Intellectual property

The content of this site, including text, articles, the interactive tool, design, layout and graphics, belongs to Bono Actuaries and Consultants (Pty) Ltd or is used under licence. The Bono name and logo are our trade marks.

You may read, print and share the articles for your own non-commercial use, provided you do not alter them and you credit the source. You may not republish, sell, systematically copy or use the content to train a machine learning model without our prior written permission.

7. Links to other sites

Where we link to a third-party site, we do so because we consider it useful. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement.

8. Liability

To the fullest extent permitted by law, and subject to the Consumer Protection Act 68 of 2008 where it applies, we are not liable for any loss or damage arising from your use of, or inability to use, this site, or from reliance on anything published on it. This includes indirect and consequential loss, loss of profit and loss of data.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.

Our liability in respect of professional work is dealt with in the engagement letter and the terms of business applicable to that work, not here.

9. Availability

We make no commitment that this site will be available without interruption or free of error, and we may change, suspend or withdraw any part of it without notice.

10. Privacy

Our handling of personal information is set out in the privacy notice, which forms part of these terms.

11. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have exclusive jurisdiction over any dispute arising from them or from your use of this site.

12. Changes

We may amend these terms. The version published on this page at the time you use the site is the version that applies, and the date at the top shows when it was last revised.

These terms are a starting point drafted for this site's content. They are not legal advice and should be reviewed by an attorney before publication — particularly clause 8, since limitation of liability is the clause most likely to be tested and the one the Consumer Protection Act most constrains.
